Member of the Indonesian Ombudsman, Dadan S Suharmawijaya, said that his agency had carried out an investigation on its own initiative regarding services in North Penajam Paser Regency and Kutai Kartanegara Regency, East Kalimantan Province. As a result, the Ombudsman found that land services had stopped applying for land certificates and land registration.
This is due to discrepancies in implementation and overlapping regulations which cause doubts among officials at the district to village level. As a result, services to the public related to submitting applications for land certificates and land registration have been disrupted.
“The conclusion is that it is proven that maladministration occurred in the issuance of certificates of control and ownership of land within and outside the IKN delineation carried out by the Kutai Kartanegara Government and the North Penajam Paser Regency Government,” explained Dadan in Jakarta, Thursday (27/7/2023).
Dadan explained that the 2022 Circular of the Director General of Land Rights Determination and Registration of the Ministry of ATR does mention restrictions on the issuance of land rights. However, in Presidential Regulation Number 65 of 2022 concerning Land Acquisition and Land Management in IKN, it is stated that land that has not been registered can be registered in accordance with statutory regulations. Nevertheless, said Dadan, there is still doubt in the practice of land-related services at IKN.
Ombudsman asks to withdraw problematic circular letter
Based on these findings, the Ombudsman asked the Ministry of ATR/BPN to revoke the Circular Letter of the Director General of Determination of Land Rights and Registration of the Ministry of ATR/BPN concerning Restrictions on the Issuance and Transfer of Land Rights in IKN Areas. The Ombudsman also asked regional governments to carry out factual identification and verification of applications for issuing certificates of land control and ownership.
“To the Head of the IKN Authority to make adjustments to the IKN delineation area so that it covers all parts of the village as a whole, not just part of it or cutting off certain village areas,” he added.
The Indonesian Ombudsman has given 30 working days for the parties to carry out Corrective Actions from the receipt of the Final Audit Results Report and the Ombudsman will monitor the progress of its implementation.
IKN Officials Ready to Follow Up on Ombudsman’s Findings
Director of Internal Supervision and Audit of the IKN Authority, Agung Dodit, said he had received a report from the Ombudsman. According to him, his party will immediately follow up on the proposed corrective action submitted by the Ombudsman.
“We will immediately finalize the regulations at IKN which are in the process of being finalized,” said Agung Dodit.
Kutai Kertanegara Regency Government Appreciates the Work of the Ombudsman
Meanwhile, the Assistant for General Administration of the Kutai Kertanegara Regency Government, Totok Heru Subroto, expressed his thanks to the Ombudsman for this report. Because, according to him, the district government also encountered the same problem, namely hesitancy in providing services. The Kutai Kertanegara District Government hopes that this report can make problems in the field clearer and community services can be carried out again.
“We have also held internal meetings, the results are almost the same. One of them is that we have prepared a Circular from the Regent to sub-district and village heads to carry out improvements and services, especially those outside the IKN delineation,” explained Totok.
Totok hopes that the Final Audit Results Report can be used as material for coordination between the regional government and the central government so that public services at IKN can return to normal. (sm/em)
