JAKARTA: The Constitutional Court (MK) has opened the process for submitting applications for General Election Results Dispute (PHPU) for the 2024 Presidential Election (Pilpres).
The pronunciation of the President and Vice President’s PHPU decision or decree is scheduled to take place on Monday, April 22 2024.
On that day, the Constitutional Court as reported by Kompas.id will announce whether the victory of the Prabowo Subianto-Gibran Rakabuming Raka pair in the 2024 presidential election is considered valid or invalid.
According to MK Spokesperson, Fajar Laksono, quoted by Detiknews, this schedule is in accordance with the provisions in MK Regulation Number 1 of 2024. The PHPU hearing of the President and Vice President lasts 14 working days from the time the application is submitted to the MK.
Fajar explained that the trial time was cut short due to the 2024 Eid holiday, but holidays were not counted as working days in the trial schedule. Therefore, the Constitutional Court must make a decision on the 14th day of the trial, namely April 22 2024.
Fajar also confirmed the Constitutional Court’s readiness to accept election dispute submissions after the KPU determines the results.
Election participants who wish to submit a legislative election (pileg) dispute must do so before 3×24 hours after the KPU decision is issued.
Meanwhile, the decision on the dispute over the legislative election results is scheduled to be read out between June 7 and June 10 2024, or within 30 working days after the case is recorded in e-BRPK.
Fajar explained the difference in the deadline for submitting election disputes between the presidential and legislative elections. For the legislative election, the time limit is determined based on the hour, while for the presidential election, it is determined based on the day determined by the KPU.
The deadline for submitting presidential election disputes will end on Saturday, March 23 2024, at 22.19 WIB.
Previously, the two pairs of presidential and vice presidential candidates, Anies Baswedan-Muhaimin Iskandar and Ganjar Pranowo-Mahfud MD, had stated their intention to contest the results of the presidential election due to allegations of fraud.
Anies has registered his lawsuit and is asking for the cancellation of the presidential election results and re-election, while Ganjar is scheduled to register his lawsuit in the near future.
